Pregnancy Discrimination at Work: Know Your Protections

Pregnancy should be a time of anticipation and preparation, not stress about job security. Federal and Pennsylvania laws provide important protections to ensure that pregnant workers are treated fairly.


What Is Pregnancy Discrimination?



Pregnancy discrimination occurs when an employer treats an employee or job applicant unfairly because of pregnancy, childbirth, or medical conditions related to pregnancy. This can include:


  • Refusing to hire someone because they are pregnant.
  • Demoting, firing, or reducing hours after learning about a pregnancy.
  • Denying reasonable accommodations, such as lighter duties or more frequent breaks.
  • Creating a hostile work environment through harassment or unequal treatment.


Federal Protections


Several federal laws protect employees against pregnancy discrimination, including:


  • Pregnancy Discrimination Act (PDA): Requires that pregnant workers be treated the same as other employees with similar abilities or limitations.
  • Americans with Disabilities Act (ADA): Covers pregnancy-related medical conditions, requiring reasonable accommodations.
  • Family and Medical Leave Act (FMLA): Provides eligible employees with up to 12 weeks of unpaid leave for childbirth, recovery, or bonding with a newborn.


Pennsylvania State Protections


In addition to federal laws, the Pennsylvania Human Relations Act also prohibits discrimination based on pregnancy. This ensures employees across the state have recourse if they experience unfair treatment.
