What Should You Do If HR Ignores Your Complaint?

Workplace issues such as harassment, discrimination, retaliation, wage violations, or other forms of misconduct should be taken seriously. Many employees are encouraged to report these problems to their Human Resources (HR) department with the expectation that the company will investigate and address the situation. Unfortunately, that does not always happen.

If HR ignores your complaint, dismisses your concerns, or fails to take appropriate action, you may feel frustrated and unsure about what to do next. While HR often plays an important role in resolving workplace disputes, it is important to remember that HR's primary

responsibility is to protect the company—not necessarily the employee.

If your complaint has been ignored, understanding your legal rights and the steps you can take may help protect your interests.

Understand HR's Role

Many employees believe HR exists solely to protect workers, but HR departments are responsible for managing employee relations while also reducing the company's legal risks. This means HR may investigate complaints, but it may also determine that no action is necessary or fail to conduct a meaningful investigation.

An employer's failure to respond appropriately to certain complaints—especially those involving discrimination, harassment, retaliation, or unlawful workplace practices—could expose the company to legal liability.

Keep Detailed Documentation

If HR is not responding to your complaint, documentation becomes even more important. Keep records of everything related to the issue, including:

  • Copies of emails and written complaints submitted to HR
  • Dates and times of meetings or conversations
  • The names of witnesses
  • Responses received from supervisors or HR personnel
  • Performance reviews or disciplinary actions that occur after your complaint
  • Any additional incidents that take place

Accurate documentation can become valuable evidence if legal action becomes necessary.

Continue Following Company Procedures

Even if HR initially ignores your complaint, review your employer's policies to determine whether additional reporting procedures exist. Some companies allow employees to report concerns to:

  • Senior management
  • Another HR representative
  • Corporate compliance departments
  • Ethics hotlines
  • Company ownership

Following internal procedures demonstrates that you made reasonable efforts to resolve the problem before seeking outside legal remedies.

Watch for Retaliation

Federal and state laws prohibit employers from retaliating against employees for reporting unlawful workplace conduct or participating in workplace investigations.

Retaliation may include:

  • Wrongful termination
  • Demotion
  • Reduced hours
  • Unfair discipline
  • Negative performance evaluations
  • Denied promotions
  • Hostile treatment after making a complaint

If negative employment actions begin shortly after you report misconduct, those actions may warrant further legal review.

Know When Outside Agencies May Become Involved

Certain workplace complaints can be reported to government agencies when employers fail to respond appropriately.

Depending on the circumstances, employees may have the option to file complaints involving:

  • Workplace discrimination
  • Sexual harassment
  • Disability discrimination
  • Age discrimination
  • Religious discrimination
  • Retaliation
  • Wage and hour violations

Many employment claims are subject to strict filing deadlines, making it important to act promptly.

Consult an Employment Attorney

If HR ignores your complaint and the workplace issue continues, speaking with an employment attorney can help you understand your legal options.

An attorney can evaluate whether your employer may have violated federal, state, or local employment laws and explain what legal remedies may be available. In some cases, early legal intervention can help preserve evidence, protect your rights, and improve your position before deadlines expire.
